- Not always. If the coaching-centre admission agreement expressly makes the fee non-refundable on withdrawal, that clause is generally enforceable — but a court can strike down a forfeiture that is disproportionate to the actual loss the centre has suffered (the Contract Act's rule on unlawful penalties). Pragmatically, most centres offer partial refunds for withdrawals within the first few weeks of the course; getting the refund schedule expressly into the agreement avoids disputes.
- Are return-service clauses in a scholarship agreement enforceable?
- Yes, if reasonable. A clause requiring the scholarship recipient to work for the sponsor for a stated number of years after graduation (or to repay the scholarship with interest if they don't) is enforceable as an ordinary contract term, provided the required service period is proportionate to the sponsorship's value and not so long that it effectively locks the student into indentured service. Courts scrutinise very long or one-sided commitments and can reduce them.
